1. Definitions and Features of Membership and Broadcaster Services.
For the purposes of this Agreement, the following terms shall be defined as set forth herein:
1.1. Basic Features: Basic features, which are available to all non-premium CamNation members, include unlimited cam show viewing, unlimited chatting, browsing and searching profiles, private messages, and friend requests.
1.2. Basic Member: A free CamNation user who has registered a user name and password. Basic members have a cam room. Basic members cannot enter a private chat; they can receive the following types of requests, but must upgrade to Premium Membership to respond or act upon it: (i) a request to go private, (ii) a friend request, (iii) a buzz, (iv) receive tokens, without the right to cash them out; (v) receipt of private messages; they cannot view cam shows in full screen; they cannot add friends, add favorites, or tip other members.
1.3. Broadcaster: Any person appearing in a Licensed Work on the Websites.
1.4. Broadcaster Ban: CamNation Broadcasters may ban any user from their rooms for any reason they see fit. Once banned, that guest may not return to the room.
To get the attention of another CamNation, user, send them a Buzz, which will vibrate the screen in their cam center. Every time a user buzzes another user, he also sends 10 tokens and a message telling them a Buzz has been sent.
1.6. Cam Center: The webcam interface by which CamNation users communicate. To enter the Cam Center, just click "Launch Cams" or the thumbnail of any live cam user.
1.7. Cam Room: Click on a live cam user's thumbnail to enter that user's Cam Room. That will launch your cam center, where you will be able to view that user as well as chat (if their settings allow). From the Cam Room, users also have the opportunity to send a tip or buzz, as well as send a friend request, add as favorite, flag a user for inappropriate behavior, or enter a private cam session. Members broadcasting live have certain controls in their cam rooms, such as allowing users in by request only, charging fees to view private sessions, and temporarily kicking out or permanently banning undesired members from the room.
1.8. Challenge/Challenge Tip: Members broadcasting live may choose to set up a challenge, that is, something they agree to do if they receive a set amount of tips from their viewers. For example: "If I receive 20,000 tokens I will drink an entire gallon of milk in five minutes or less." Viewers can then send a tip in order to fulfill the specific challenge. The member who set up the challenge may only accept those tips if viewers meet the challenge amount, and the challenge is completed. If viewers do not meet the challenge amount, the challenge may be completed at a lesser amount, or the challenge tip tokens must be released back to viewers. Viewers should contact customer service if Broadcasters are abusing the challenge guidelines by not meeting challenges and accepting challenge tips anyway.
1.9. Chat Window: The window to the right in the cam center where registered members may chat with Broadcasters and other members in a Broadcaster's room.
1.10. Derivative Work: Any and all modifications, re-creations, duplications, reproductions, and compilations of Licensed Works and Related Licensed Content;
1.11. Favorite: Premium members may select other CamNation members as their favorites. Favorite members' thumbnail icons will be stored in users' cam center and live Broadcasters can be sorted by favorites so users can easily return to their rooms. Basic members and guests may not store favorites.
1.12. Flag: While viewing a member in a cam room, any CamNation user may flag that member if they feel she is violating basic decency or any of the site's terms, such as using excessive profanity, hate speech, threats, violence, harassment, etc. CamNation administration will review all flagged users before taking further action.
1.13. Free Private Group: A cam chat that is open to multiple users by request only. There is no per minute charge for a free group private session. The Broadcaster must approve the group members. Free Private Sessions are not open to users in Guest status.
1.14. Free Private One-on-one: A private session between two Members, created when one Member sends another a one-on-one chat request, provided the Member being sent the request has private settings set to free. Voyeurs are not allowed in free one-on-one sessions.
1.15. Friend Request: Premium and VIP Members may send friend requests to other members, and, if the request is accepted, those members will appear on the user's list of friends. Friends also have access to the private area of each other's profiles. Some Broadcasters only accept private messages, or only perform private shows, for approved friends and VIPs. A Broadcaster has three friend request settings: 1) accept friends automatically; 2) accept friends manually; 3) accept friends automatically for a fee. VIPs' friend requests are automatically accepted.
1.16. Group Private: This type of cam show is either by invitation or not, depending on the Broadcaster's settings. Anywhere from two to an unlimited number of viewers may be watching a group show at a charge of anywhere from 10 tokens per minute to any other amount that the Broadcaster chooses in her settings. Viewers must accept the set charge before viewing a group private session.
1.17. Guest: When non-registered CamNation users are on the site, interacting in any cam room, they are in guest status. Guest status enables a user to watch a cam room, and, if the owner of that room selects it in her settings, to chat as well. Like all users, a guest can flag a member for inappropriate behavior while viewing her cam room. A guest does not have a user name or a profile; a guest cannot tip Broadcasters; a guest can only watch a limited amount of video per day.
1.18. Guest Features: Available to all non-registered guests of CamNation, guest features include limited cam show viewing and browsing profiles.
1.19. Headline: A Broadcaster may post a message at the top of his chat log window. That headline will remain until the Broadcaster changes it. The Broadcaster can change their headline as often as they want to, or just keep it blank. Examples: "Today I need to make 100,000 tokens, so be generous;"
1.20. Ignore: A Broadcaster may choose to take away a guest's ability to chat with anyone in the room, but still allow the guest to remain in the cam room for the length of the session. A guest who has been "ignored" mutes the guest's ability to communicate, while still allowing them to watch the show.
1.21. Kick: Broadcasters may kick anyone out of their cam rooms for any reason they see fit, for 24 hours.
1.22. Licensed Work: The visual or audiovisual work broadcast by Broadcaster on the Websites during the term of this Agreement and shall include, without limitation, all live performances by Broadcaster (the "Performance"), including all pictures and text pertaining to or marketing the Performance;
1.23. Options: All CamNation members have access to their cam room and chat settings through the option link, located at the top right of the screen. Options control whether or not you engage in mature behavior on your cam, whether or not you want to see others engaging in mature behavior, and whether you will host paid private cam chats, as well as how much you'll charge per minute for private cam chats.
1.24. Paid Group: A cam chat that is open to multiple users; a per-minute charge applies to paid group sessions. Paid groups occur when one user sends another user a request to go private, and more users join the session. No approval is necessary by the group owner, as long as subsequent users agree to pay the per-minute fee. Voyeurs may be watching paid group sessions.
1.25. Payment Enabled: Premium members may charge a per-minute fee for group private and one-on-one sessions after setting their options and following steps to become payment enabled.
1.26. Payment Options: Premium members may turn on their payment options to host paid group private or one-on-one cam sessions, and to charge tokens to accept friend requests.
1.27. Premium Features: Available to premium CamNation members, premium features include unlimited cam show viewing; unlimited chatting in cam rooms; unlimited browsing and searching profiles; adding favorites; limited use of voyeur mode; sending and receiving messages, tokens, and buzzes; sending and accepting friend requests and unlimited access to all profiles including the contact information of the profile owner.
1.28. Premium Member: Registered members who purchase CamNation token packages. Premium members have access to all premium features,
1.29. Private Message: Premium members may send private messages to other CamNation members. Members can modify their preferences to receive messages from friends or VIPs.
1.30. Private One-on-one: A one-on-one session between a user and a webcam Broadcaster, though voyeurs may be present in a private cam room.
1.31. Profile: Each CamNation member has a profile page, which contains detailed information, including photos, bio, and other personal interests. Members can edit profiles to their specifications, and other members can contact them through their profile page. A profile may also be used to invite new users to the site through a referral link, or to encourage users to upgrade to premium membership. Profiles for payment-enabled members also contain a private area, viewable only by friends. The private area contains that member's private images and video.
1.32. Quarantine: At certain instances, it may become necessary for a CamNation administrator or customer service representative to communicate directly with a user. Admin controls allow a user to be taken out of whatever cam room he is viewing and sent to a private room with the site representative for a one-on-one chat, to discuss whatever issue may be at hand. Reasons for quarantine may include harassment or other violation of CamNation's terms, which would result in a warning but not dismissal.
1.33. Quick Text: Broadcasters may send preset messages through their chat box with just one click. In addition to the default quick text messages, a user can add custom messages, too. There is no limit to how many quick text messages a Broadcaster can set. Example: "Hey cutie, how's it going; I'm 24 years old, how about you?"
1.34. Referral: When a new user comes to CamNation through another member's referral link (though a chat IM, a banner ad, or other link containing an account ID), the referring member will earn money for bringing the new user to the site.
1.35. Related Licensed Content: Any and all works, videos, or images related to Licensed Works in any way; any and all material used to promote or market Broadcaster; and any and all other works, videos, or images otherwise posted by Broadcaster on the Websites;
1.36. Room Challenge: A Broadcaster or viewer may set up an event that will happen if the Broadcaster collects the challenge reserve. Members inside the room can add tokens, until the challenge reserve is met. If the total number of tokens is not collected and the Broadcaster does not meet the challenge, the Broadcaster must release the tokens, which refunds users. .
1.37. Search: The search feature allows members to find other members by screen name, age location, or any number of physical attributes..
1.38. Voyeur Mode: A premium member may join a one-on-one private session anonymously using voyeur mode, which means that other chat participants will not know he is in the cam room. While in voyeur mode he will not be able to communicate with others in the room, but he may watch the show. The cost of joining a room as a voyeur is 1/3 of the normal per-minute charge. Additionally, VIPs can join private groups in voyeur mode.
1.39. Tip: Premium members (members who have tokens in their CamNation wallets) may send other members gifts of tokens for any reason, without any expectation from either party to do anything.
1.40. Token: The currency used on CamNation for tips and gifts. The value of a CamNation token is .10 cents per token, though tokens may be purchased in discount packages. All price points subject to revision.
1.41. Ultra Private One-on-one: A one-on-one interaction between a user and a webcam Broadcaster. There are absolutely no voyeurs in ultra private webcam shows, so anything goes!
1.42. Upgrade: An upgrade occurs when a guest user moves to membership status, or when a basic member moves to premium membership or VIP status.
1.43. Viewer: Any CamNation user who is watching a live cam Broadcaster.
1.44. VIP Features: VIP members receive all CamNation features, plus unlimited use of voyeur mode in one-on-one and group private sessions.
